What is Sole Legal Custody?

In part of the Legal Custody post, we talked about who makes decisions on a child or children’s behalf. Today we will talk about what Sole Legal Custody is.

Sole Legal Custody is when one parent is granted the right to make all major decisions on behalf of a child or children of the marriage. This usually means they can solely make decisions regarding a child’s school to attend, religion to practice, doctors to see, etc… The Non-Custodial parent may be entitled to knowledge of these decisions, but generally is not entitled to make any of these decisions. There are usually some restraints to Sole Legal Custody. Sole Legal Custody discussions can be a major portion of a Divorce proceeding if in dispute amongst parents (one parent wanting it versus the other parent potentially not willing to relinquish it).
