Grounds for Divorce

In today’s blog post, we will discuss what Grounds for Divorce are.

A Ground is a reason for a Divorce in New York. And Grounds usually have to be proved.

For example, to get a Divorce in New York, Adultery was a Ground for Divorce. And that had to be proved. An allegation usually wasn’t enough. So basically, any Ground alleged had to be proved in order to get a Divorce. Then, about 2010, New York adopted what is known as the No-Fault Statute (a No-Fault Divorce). In order to use this Ground, you do not have to prove Fault (as is in the name: a No-Fault Divorce), you usually just have to allege Irreconcilable Differences within the last 6 months.
